1. Definitions

In this document, the following words have the meanings setup below:

1.1 “The service provider” means, MustangFinds.com, is a website for introducing the selling of goods and services to buyers and for use as a general local notice board.
1.2 “Content” means information, text, images, photographs or other material posted on the site.
1.3 “The site” means the website of the service provider.
1.4 “The advertiser” means a person using the site for the purposes in 01 above or for any other purpose, which the service provider considers legitimate.
1.5 “User” means any advertiser or person responding to content posted on, or gaining access to the site.
1.6 “Terms & conditions” means these terms and conditions of use.
1.7 The use of the masculine gender includes the feminine and neuter genders.

2. Acceptance of these terms & conditions

An advertiser or user is deemed to have agreed to be bound by these terms & conditions by the act of posting a classified advertisement on the site (MustangFinds.com).

3. Duration of classified advertisements

All classified advertisements are published on the site for a period not exceeding 30 days unless removed by the service provider in accordance with these terms and conditions.

4. Control of content submitted by advertisers

4.1 The service provider reserves the right to approve, at its sole discretion all content submitted for posting on the site and is entitled to decline the posting of any content which it decides is unacceptable.
4.2 The advertiser hereby agrees to indemnify the service provider against all claims that maybe brought against the service provider arising from the posting of the advertiser’s content on the site.
4.3 The service provider shall not be liable in damages to the advertiser as a consequence of posting or declining to post or incorrectly posting any of the advertiser’s content on the site.
4.4 The advertiser shall not post content on the site which infringes any copyright, patent or other intellectual property right of a third person.
4.5 The service provider is not responsible to the advertiser for ensuring that the content, which the advertiser seeks to post, is not unlawful or injurious to or infringes the rights of third persons.

5. Privacy and disclosure of information

5.1 The service provider undertakes to protect the privacy of advertisers except to the extent that it is necessary to disclose sufficient information on the site to enable advertisers and respondents to communicate with each other in accordance with the purposes intended to be achieved by the site.
5.2 The extent of personal information (e.g. name, email address, phone number etc…) that is posted on the site is left entirely to the discretion of the advertiser but whatever is so disclosed by him will not thereafter be made available to third parties by the service provider unless obliged by law to do so.

6. Unacceptable site content

You (the advertiser) agree not to post on the site, content which:

6.1 that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way;
6.2 that is pornographic or depicts a human being engaged in actual sexual conduct,  including but not limited to (i) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex, or (ii) bestiality, or (iii) masturbation, or (iv) sadistic or masochistic abuse, or (v) lascivious exhibition of the genitals or pubic area of any person;
6.3 that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
6.4 that impersonates any person or entity, including, but not limited to, an employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.);
6.5 that includes personal or identifying information about another person without that person's explicit consent;
6.6 that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";
6.7 that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
6.8 that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
6.9 that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.
6.10 post the same item or service in more than one classified category or forum, or in more than one metropolitan area;
6.11 contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose;
6.12 "stalk" or otherwise harass anyone;
6.13 collect personal data about other users for commercial or unlawful purposes;

7. Advertisers’ undertakings

The advertiser agrees that he will not:

7.1 harass other users of the site,
7.2 use the site to gather information about other site users for commercial or unlawful purposes,
7.3 post the same content in more than one category,
7.4 attempt to gain unauthorized access to the site’s server,
7.5 post irrelevant content on the site

8. Access to the site

An advertiser may not change of modify any part of the site other than content introduced by the advertiser in the fields provided.

9. Limitation on use of the site and termination of use

The service provider:

9.1 may establish limits or parameters regarding any aspect of the use of the site,
9.2 may delete content at any time,
9.3 alter the site or its get-up,
9.4 may terminate an advertiser’s access to and use of the site at its sole discretion,
9.5 will not be liable for any loss or damage to an advertiser or user arising from the exercise of any of its above prerogatives

10. No creation of agency or warranties by service provider

10.1 The service provider shall not at any time be deemed to be the agent of any user and no user shall have any recourse to, or claims against, the service provider in relation to any dealings or contracts concluded between users and/or in relation to goods or services supplied arising from such dealings or contracts.
10.2 The service provider does not by virtue of the appearance of any content on the site, give any warranties to any user concerning the nature or quality of the articles or services offered or advertised on the site.
10.3 The site provider shall not be required to mediate in, or become involved in any dispute between users.
10.4 Advertisers agree that they make use of the site entirely at their own risk and the service provider shall not be liable for any virus transmissions emanating from the site.

11. The service provider’s intellectual property rights

11.1 The site and the service provider are protected by the laws of Copyright and no unauthorized duplication of the site or its content or get-up is permissible.
11.2 Users shall not attempt to discover the source code of the site.
11.3 By posting content on the site, users are granting to the service provider, the right to such content for use by it in any way it may deem fit, and furthermore, to prohibit any other party from using such content in any way.

12. Indemnity

Advertisers hereby agree to indemnify the service provider and its employees against any losses and expense it or they may incur as a result of involving the service provider in any dispute between users.

13. Payments

13.1 The service provider will initially not charge for posting classified advertisements except that where a classified advertiser chooses a Featured Listing (for the purposes of this close, the term “Featured Listing” means an advertisement which is highlighted and/or positioned at the beginning of any category list), the charges for same will be as set out in the appropriate field displayed during the posting process.
13.2 The service provider reserves the right in the future to vary the charges for any paid listings and to introduce charges for various categories of classifieds advertisements, without prior notice.
13.3 If any paid content infringes against these terms and conditions, the service provider may remove the content and ban the originator of the content from further access to the site without prior notice or refund.
13.4 Payment of monthly recurring accounts:

Holders of these accounts agree to pay the service provider for all content submitted for posting, prior to posting on a pro rata basis for any part of a month and thereafter on the first day of each succeeding month during which the content will appear.
If the holder of a monthly recurring account fails to make payment on due date, the service provider shall be entitled to remove all content posted by such account holder until payment is received while still charging the full price for the removed content.
If the account holder does not make payment thereafter, the service provider may permanently remove the content from the site and reserves the right to recover any unpaid amounts due on the account.

13.5 In relation to any content whether paid for or not, the service provider is not responsible for the success or failure of any content posted on the site, to achieve the end intended by the advertiser.
13.6 Where payments are required, such payments shall be made through PayPal payment solution.

14. General

14.1 These terms and conditions of use constitute the entire agreement between the users and the service provider and no amendment to them shall be regarded as binding on the parties unless such amendment is assented to in writing by both parties.
14.2 If the service provider does not act on a breach by a user of these terms and conditions of use, such failure to act shall not constitute a waiver of the service provider’s right in relation to any further breach.
